August 13, 2007Widow awarded $19.2M in railroad injury lawsuit
A jury in New Jersey has awarded a $19.2 million verdict to the widow of a former railroad worker. Catherine Fuccilli filed a railroad injury lawsuit against the former employers of her husband, Roger, who died of pulmonary fibrosis in 2002.
Roger Fuccilli worked as a railroad car repairman for New Jersey Transit for 18 years and was also employed by the Central Railroad company for about 18 months. According to his railroad lawyers, Fuccilli was responsible for maintaining and repairing brakes that contained asbestos and silica as part of his duties. He was also exposed to metal dust and welding fumes in the course of his duties.
As a result of the hazardous materials, silica and asbestos exposure that Fuccilli suffered, he was diagnosed with pulmonary fibrosis in June 2000. Because of his illness, he was placed on an oxygen supply, and later a respirator, in order to counteract the strangulating effects of his pulmonary fibrosis. Fuccilli eventually died of the disease in 2002.
Jurors awarded Fuccilli’s widow $4.1 million for the pain and suffering that he experienced as a result of his railroad injuries. In addition, Mrs. Fuccilli was awarded $15.1 million for her husband’s wrongful death.
