August 29, 2007Railroad worker files FELA lawsuit over knee injuries
A railroad worker has filed a lawsuit under the Federal Employees Liability Act (FELA) alleging that he suffered railroad injuries as a result of negligence on the part of his employer. Tim Throne alleges in his railroad injury lawsuit that the Northern Suffolk Railway failed to provide him with a safe place to work, causing him to suffer injuries as a result of repetitive trauma.
Throne began working for Northern Suffolk in May 1976. During the 31 years that he has worked for the company, Throne says that he regularly used tools and machines provided by his employer which have caused him to suffer trauma and vibration injuries to his knees.
In his railroad injury lawsuit, Throne alleges that Northern Suffolk violated FELA regulations by failing to provide him with tools and equipment that would have reduced the vibrations that caused his injuries, even though they were foreseeable. In addition, he alleges that the company failed to instruct him in safe working methods that would have prevented his injuries, failed to provide adequate supervision or manpower and failed to warn him that he had developed repetitive trauma injuries.
Throne alleges in his FELA case that his permanent injuries have caused him pain, suffering, lost wages and medical expenses. He is seeking damages in excess of $50,000 plus costs.
