September 1, 2007Jury awards $19.3M to workers in railroad lawsuit
A jury in Maryland has awarded eight railroad workers a total of $19.3 million in their railroad injury lawsuit against CSX Transportation Inc. The lawsuit alleged that dangerous working conditions at the CSX rail yard caused all eight of the victims to develop serious lower body injuries.
According to their railroad injury lawsuit, the eight workers’ injuries were caused by a combination of improper working conditions and potentially dangerous job duties. The workers allege that they suffered injuries to their lower bodies as a result of being repeatedly forced to climb railroad cars and to get on and off moving trains.
In addition, the workers allege that CSX violated regulations by placing mainline ballast in the rail yard rather than walking ballast. Studies have shown that railroad workers who regularly walk on mainline ballast face an increased risk of railroad ballast injuries due to the increased stress it places on their lower bodies.
According to the lawsuit filed by their railroad injury lawyers, all of the eight workers have developed osteoarthritis in their knees as a result of their injuries. One of the workers has also had knee surgery to correct his injuries and will require knee replacement surgery in both knees in the future. Another of the railroad workers has been left permanently disabled because of his injuries.
